1. Introduction
Welcome to the Learning Management System (LMS) platform (“Platform”) operated by Aktrea Learning Xperience Private Limited (“Aktrea”, “Company”, “we”, “our”, “us”). These Terms and Conditions (“Terms”) govern your use of our LMS platform and related services provided through enterprise-specific domains (e.g., [enterprise].aktreasolutions.com).
By accessing or using our Platform, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Platform.
2. Platform Access and Authentication
2.1 Enterprise Access
- Access to the Platform is provided exclusively through enterprise client arrangements
- Users must authenticate through enterprise-approved authentication methods (e.g., Single Sign-On)
- Access credentials and permissions are managed according to enterprise client specifications
2.2 User Account Responsibilities

- Off-the-shelf courses are licensed, not sold, on a per-user basis
- Custom content ownership is governed by specific enterprise agreements
- All content access is subject to enterprise-specified permissions
3.2 Platform Features
- Course access and completion tracking
- Assessment participation and results recording
- Learning progress monitoring
- System-generated notifications and reports
- Enterprise-specific features as contracted
4. Intellectual Property Rights
4.1 Platform and Content
- The Platform and its original content remain the property of Aktrea
- Off-the-shelf course materials are protected by copyright laws
- Custom-developed content ownership is determined by enterprise agreements
- We retain ownership of our development frameworks and methodologies
4.2 Prohibited Activities
Users may not:
- Copy, modify, or distribute Platform content without authorization
- Attempt to decompile or reverse engineer the Platform
- Use data mining, robots, or similar data gathering tools
- Share access credentials or course materials with unauthorized users
- Use the Platform for any unauthorized commercial purpose
5. Data Processing and Privacy
5.1 Data Processing Role
- We operate as a Data Processor under the direction of enterprise clients
- All data processing activities are performed according to client instructions
- User data is managed according to our LMS Platform Privacy Policy
- Data subject rights requests should be directed to your organization
5.2 Data Security
- Platform access is restricted through role-based authentication
- Data is protected through encryption in transit and at rest
- Regular security audits and monitoring are performed
- Comprehensive backup and disaster recovery procedures are maintained
6. User Responsibilities
Users agree to:
- Provide accurate information when required
- Use the Platform in compliance with applicable laws and organizational policies
- Maintain the security of access credentials
- Not engage in any activity that disrupts Platform services
- Not attempt unauthorized access to Platform systems or content
7. Communications
7.1 Platform Notifications
- System-generated notifications related to learning activities
- Course assignment and completion reminders
- Enterprise-approved communications
- Learning progress reports
7.2 Email Practices
- Emails sent only for legitimate Platform-related purposes
- Communication frequency follows enterprise specifications
- All communications branded according to enterprise requirements
8. Disclaimer and Limitation of Liability
8.1 Service Availability
- We strive to maintain Platform availability but do not guarantee uninterrupted access
- Platform maintenance and updates may cause temporary unavailability
- Specific service levels are governed by enterprise agreements
8.2 Limitation of Liability
To the fullest extent permitted by law:
- We shall not be liable for any indirect, incidental, special, or consequential damages
- Our total liability is limited to the amount paid for the specific service giving rise to the claim
- Platform and content are provided “as is” without warranties of any kind
9. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be communicated through the Platform or enterprise administrators. Continued use of the Platform after changes constitutes acceptance of modified Terms.
